A Brief Guide To Power Of Attorney For Estate Planning
When talking about power of attorney for an estate plan, largely we’re referring to a durable power of attorney. In other aspects of your life, you may use a limited power of attorney to have a trusted individual negotiate on your behalf – such as in a home purchase. But in that case, when the negotiation ends, so does the power.
A durable power of attorney lasts through any of the normal circumstances that would end a non-durable power of attorney, such as becoming incapacitated. This is important because it allows you to select someone who can make decisions for you when you no longer can. In Texas, you can have two different roles:
- Medical power of attorney
- Financial power of attorney.
The medical power of attorney can make decisions about your medical care, and a financial POA is focused solely on the care of your estate, similar to that of a guardian or conservator. You can choose to have these powers with the same person or with different people. The choice is yours.
