The Holidays – Merriment and Misadventure

With Memorial Day weekend coming up, it’s worth a reminder that DWI enforcement will be heavily increased, as it is around most holidays. Americans party with enthusiasm. Our holiday calendar is packed with celebrations that unite friends and relatives to share food, laughter, and often booze. Celebrating is American, yet these festive seasons also present dire dangers. One of the most overlooked dangers during the holiday season is the sharp rise in drunk driving accidents. What begins as a time of celebration can turn tragic in an instant when someone chooses to drive after consuming alcohol. Law enforcement has a heightened awareness of the increased number of intoxicated drivers around holiday, and everyone should keep that in mind as we roll into another weekend of festivities.

According to the Centers for Disease Control and Prevention, in 2018 alone, an intoxicated driver operated their vehicle an estimated 147 million times. Additionally, the CDC documented 10,511alcohol-involved deaths that year. That’s not just a number, that’s lives lost, families broken, and communities forever changed.

In 2018, drunk driving in Texas accounted for 26 percent of the state’s overall traffic fatalities. And that is just one statistic. Across the country, the drunk driving death toll surges fantastically during the holidays. Various law firms and emergency rooms across the country see the consequences of these choices up close. We see at our office quite often clients who are the victims of someone else’s poor decision to drink and drive. These are not just legal cases; they’re sad stories of pain, recovery, and unnecessary loss.

The Most Dangerous Holidays for DWI
We have all heard the warnings that pop up around holidays. Whether it is “Drive safe, people will be out drinking tonight” or news alerts about upcoming DWI checkpoints, these reminders are not just seasonal talking points and they are essential cautions backed by hard data.

A recent study by MoneyGeek looked at what holidays are most dangerous for DUI, based on national traffic and law enforcement data. What it discovered is both surprising and sobering.

1. New Year’s Eve
Leading the list is New Year’s Eve. Marked by evening revelries, champagne appearances, and big parties, this holiday is also behind the greatest increase in drunk driving arrests. In fact, the chances of encountering an intoxicated driver on New Year’s Eve and into the early morning are 129 percent higher than an average day. That’s a gigantic rise in risk for any driver behind the wheel.

2. Labor Day
Labor Day was enacted to honor the contributions of working-class Americans, but the holiday weekend has also become a dangerous time on the roads. The relaxed atmosphere and increase in social partying lead to more drinking. What should be a day off from the job can become a costly and life-altering mistake.

3. The Fourth of July
Independence Day comes in at a close second. The Fourth of July means family, fireworks and barbecues. However, it’s also the deadliest week of the year for drunk-driving accidents. There is twice the risk of being arrested for a DWI during the holiday itself. Freedom shouldn’t be brought about through the harm of another, but this is one of those weeks when bad choices too often are made in the vehicle.

4. Memorial Day
Often regarded as summer’s kickoff, Memorial Day weekend sees increased travel and socializing. Memorial Day also happens to be the second deadliest weekend of the year period with alcohol-related fatalities. What should be a celebration of service men and women who have lost their lives becomes too often the cause of additional preventable tragedies.

5. Thanksgiving
Thanksgiving is when families reunite and share comfort food. The night before Thanksgiving, however, has gained further-negative reputation. Informally spoken as “Blackout Wednesday” or “Dranksgiving” it is one of the busiest nights for bar traffic and alcohol consumption. According to the AAA Foundation for Traffic Safety, the most dangerous time to drive is between midnight and 3 a.m., a window that overlaps with post-bar traffic during this unofficial drinking holiday.

The Real Cost of a DWI
The numbers leave no uncertainty concerning one thing: the most cheerful days on the calendar tend to be among the most dangerous. The consequences of a DWI go far beyond an arrest or court appearance. A conviction can mean significant fines, suspension of license, education or treatment programs, and jail time, in some cases. It is costly, but the emotional and social consequence are normally worse.

For the victims of an inebriated driver, the cost is greater. Victims are subjected to bodily injury, psychological trauma, and monetary loss as a result of medical bills and lost earnings. In the worst cases, families are left grieving the loss of a loved one, aware it was the result of an absolutely avoidable decision.

It is also worth mentioning that the judicial system does not take holiday DWIs lightly. High-profile police presence, stiffened penalties, and increased public scrutiny all stand to enter the picture. As victim or driver, these cases must be dealt with immediately by an experienced attorney.

You’ve Heard it Before, but Responsible Drinking is Key
Party responsibly. Plan ahead. If you are going to have a drink, make arrangements for a sober driver, take a ride-sharing service, or don’t move. Don’t think you are safe to drive because you feel fine. There are many ways to spoil a good time, so, please, plan ahead.

By being intelligent and making others intelligent, we can minimize risk on our roads and ensure holidays are times of joy rather than tragedy.
